The Phone Guy Site

The Site and its content are the property of ADS Mobile Services, S. de R.L. de C.V. and/or its subsidiaries, affiliates and/or companies belonging to the same economic group (collectively, “Phone Guy”). Phone Guy provides no warranty regarding its content. Phone Guy shall not be liable for any contingency related to the use of the Site or its content. Specifically, Phone Guy is not responsible for the accuracy, completeness, sufficiency, currency, timeliness, or exhaustiveness of the information contained on the Site, which may change from time to time or be modified by Phone Guy at any time, without liability and without prior notice. It is the user’s sole responsibility to ensure they are aware of such modifications.

Reference to any Phone Guy product or service on the Site does not necessarily imply that such product or service is available in your location. If you do not fully and absolutely accept the Terms and Conditions, you must refrain from accessing, viewing, and/or using the Site. Continued use of the Site shall be understood as acceptance of these Terms and Conditions.

License to Use

By entering into this agreement, Phone Guy grants the user a non-exclusive, revocable, non-transferable right to view and use the Site in accordance with these Terms and Conditions. For purposes of this agreement, “user” means any person of any nature who accesses the Site and/or any of its subpages, and/or any person who registers and/or uses any services offered through the Site.

The user agrees that they may print and/or copy any information contained or published on the Site exclusively for personal use. Any commercial use of such information is strictly prohibited.

Reprinting, publishing, distributing, assigning, sublicensing, selling, or reproducing—electronically or by any other means—any information, document, or graphic appearing on the Site, in whole or in part, for any purpose other than personal, non-commercial use, is expressly prohibited unless the user has prior written authorization from Phone Guy.

Rules of Use

To access the Site, the user is responsible for their own device and for obtaining the necessary internet service, which may require payments to third parties (such as an Internet Access Service Provider). Phone Guy is not responsible for the quality of your internet access service.

Phone Guy assumes no responsibility for content provided on the Site by independent providers or third parties unrelated to Phone Guy and has no editorial control over content, information and/or materials generated and/or provided by third parties. All opinions, advice, statements, services, offers or other information or content made available to the public by third parties belong to their respective authors, and Phone Guy assumes no liability in this regard. Likewise, Phone Guy does not guarantee the accuracy, truthfulness, breadth and/or usefulness of content provided by such third parties. Additionally, Phone Guy is not responsible for or does not guarantee the accuracy, completeness, truthfulness and/or reliability of any opinion, information, advice or statement expressed by third parties through the Site, and under no circumstances shall Phone Guy be liable for any damage, direct or indirect, resulting from the user’s reliance on information obtained through the Site and provided by third parties. Phone Guy reserves the right to remove or modify content on the Site that, in Phone Guy’s sole judgment, does not meet its standards or may be contrary to applicable law; therefore, it shall not be liable for any failure or delay resulting from removing such material.

As a condition of using the Site, the user shall not use the Site or any materials for any unlawful purpose or any purpose prohibited by these Terms and Conditions. The user must not use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. The user may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided through the Site. It is the user’s responsibility to take precautions to ensure any materials selected for use are free of viruses, worms, Trojan horses, and other destructive items.

Information that Phone Guy obtains from the user through the Site is subject to our Privacy Notice. By using the Site, the user consents to the collection and use of such information as set forth in our Privacy Notice. In all cases, users are responsible for the truthfulness of the information provided to Phone Guy. Likewise, for the provision of services, the user also agrees to accept the specific terms and conditions established for such services.

The following are examples (not an exhaustive list) of prohibited illegal or harmful conduct:

Forgery/Impersonation: You must not use the Site to impersonate any person or entity, or create a false identity to mislead others. You must not falsify addresses, message headers, or domain names.

Violation of Laws and Intellectual Property: You must not infringe intellectual property rights (including copyrights, trademarks, patents, trade secrets, or other applicable rights). Copying, distributing, and/or publishing without authorization images, logos, software, articles, musical works, and videos appearing on this Site typically results in infringement of our copyrights or third-party copyrights.

Offensive Materials: Publishing or distributing defamatory, obscene, pornographic, threatening, discriminatory, harmful, aggressive material, or material that violates a third party’s privacy or other rights. In particular, accessing or using our Site to transmit or disseminate images containing child pornography is not permitted.

Prohibited Communications: It is not permitted to distribute, publish, or send through our Site unsolicited bulk email (spam), including advertising, solicitations, commercial email messages, informational notices, or any type of unsolicited promotional message; chain letters; multiple copies of identical or highly similar messages; empty messages; messages without substantial content; large messages or files that create server problems; or any message classified as “phishing.”

Excessive Use of the Site: Excessive use intended to damage, affect, or degrade the Site is not permitted.

Affecting Third Parties: It is not permitted to harass or disturb third parties through the Site, nor to carry out any commercial transaction or fraudulent practice, including collecting email addresses, names, or other identifiers of third parties (including “spyware”), or obtaining responses through unsolicited messages.

Intellectual Property

Phone Guy, the Site, its logos, and all materials appearing on the Site are trademarks, domain names, trade names, and artistic works owned by their respective holders and protected by international treaties and applicable intellectual property and copyright laws. Copyrights in the content, organization, compilation, information, logos, photographs, images, programs, applications, and in general any information contained or published on the Site are duly protected in favor of Phone Guy, its affiliates, suppliers, and/or their respective owners, in accordance with applicable intellectual and industrial property laws.

Users are expressly prohibited from modifying, altering, or deleting, in whole or in part, notices, trademarks, trade names, signs, advertisements, logos, or any indication referring to ownership of the information contained on the Site.

If the user transmits to Phone Guy any information, programs, applications, software, or any material that requires licensing through the Site, the user hereby grants Phone Guy a perpetual, universal, free, non-exclusive, worldwide, royalty-free license, including the right to sublicense, sell, reproduce, distribute, transmit, create derivative works, publicly display, and publicly perform such material. The foregoing applies equally to any other information the user sends or transmits to Phone Guy, including, without limitation, ideas for renewing or improving the Site, whether included in any area of the Site or transmitted through other means now known or developed in the future. Accordingly, the user expressly waives any action, claim, or demand against Phone Guy, its affiliates, or suppliers for any current or potential infringement of copyrights or intellectual property rights arising from the information, programs, applications, software, ideas, or other material submitted by the user to the Site and/or Phone Guy.

Representations

The user agrees that use of the Site is at the user’s own risk and that the services and products offered are provided “as stated on the Site” and only as available. Phone Guy does not guarantee that the Site will meet user requirements, that the services will be uninterrupted, secure, or error-free. Phone Guy does not guarantee or endorse the truthfulness, accuracy, legality, morality, or any other characteristic of the content published on the Site. Phone Guy disclaims all liability and conditions, express or implied, regarding services and information contained on or available through the Site, including, without limitation: (a) availability of use of the Site; (b) absence of viruses, errors, disabling devices, contaminants, destructive functions, or any failure on the Site; and (c) notwithstanding the foregoing, Phone Guy or its providers may constantly update Site content, so some information may be outdated and/or contain inaccuracies.

Limitations of Liability

To the extent permitted by applicable law, Phone Guy shall not, in any case, be liable for direct, special, incidental, indirect, or consequential damages arising from or related to: (a) use or performance of the Site or delays or unavailability of use; (b) the provision or omission of services, or any information or graphics contained or published on or through the Site; (c) updating or failure to update information; (d) alteration or modification, in whole or in part, of information after being included on the Site; and (e) any other aspect or characteristic of the information contained or published on the Site, including links that may be included.

Modifications to the Site and/or the Agreement

Phone Guy may, at any time and when it deems convenient, without notice to the user, make corrections, additions, improvements, or modifications to the content, presentation, information, services, areas, databases, and other elements of the Site, without giving rise to any claim or compensation and without implying recognition of liability in favor of the user. Phone Guy reserves the right to modify these Terms and Conditions at any time, with such modifications becoming effective immediately by: (a) publication on the Site, or (b) notice to the user.

Accordingly, the user should review this agreement periodically to remain informed of modifications. Each time the user accesses the Site, it shall be considered absolute acceptance of the modifications. From time to time, Phone Guy may add additional provisions relating to specific areas or new services provided on or through the Site. The user acknowledges and agrees that such additional terms form an integral part of this agreement for all legal purposes.

Indemnification

The user shall indemnify Phone Guy, its affiliates, suppliers, vendors, and advisors against any action, demand, or claim (including attorneys’ fees and court costs) arising from any breach by the user of this agreement, including, without limitation: (a) any aspect related to use of the Site; (b) information contained on or available through the Site, or insults, defamation, or any other conduct violating this agreement by the user while using the Site; and (c) violation of applicable laws or international treaties related to copyright or intellectual property rights contained on or available through the Site.

Termination

Phone Guy reserves the right, at its sole discretion and without notice to the user, to: (a) terminate this agreement definitively; and (b) discontinue or permanently stop publishing the Site, without liability to Phone Guy, its affiliates, or suppliers.

Survival / Entire Agreement

These Terms and Conditions of Use, as well as any additional terms, constitute the entire agreement between the parties and supersede any prior agreement. Any clause or provision declared legally invalid shall be removed or modified at Phone Guy’s discretion to cure the defect; however, the remaining clauses shall remain in full force and effect.

No Waiver of Rights

Failure by Phone Guy, its affiliates, or suppliers to exercise any right or action arising from this agreement shall not be interpreted as a waiver of such rights or actions.

Governing Law and Jurisdiction

This agreement shall be governed by and interpreted in accordance with the laws of Mexico and submitted to the courts of Mexico City, Mexico.

Our Site may contain links to other websites that may take you outside our Site. These external websites are operated by third parties over whom Phone Guy has no control. If you choose to use third-party websites, you do so at your own risk. Phone Guy provides no warranty regarding information, products, or services offered by such websites, nor regarding their privacy practices and policies.

Checking device compatibility is the customer’s sole responsibility and must be done before purchase to ensure service.

Top-Ups (Recargas)

Top-ups through:

All top-ups performed through the Phone Guy App, the Phone Guy top-up website https://recarga.koonolmexico.com/mexfon
, or the Phone Guy Chatbot—if successfully applied to the customer’s Phone Guy number—may not be refunded at any time, since they were applied successfully and the customer authorized such transactions.

If the customer top-ups through the Phone Guy App, the top-up website https://recarga.koonolmexico.com/mexfon
, or the Phone Guy Chatbot and is unsure whether the top-up was applied or successful due to unstable connection or a system error message, they must contact our customer support channel to confirm the top-up before attempting additional top-ups, to avoid consecutive requests or multiple top-ups being applied simultaneously.
